Terms of Service

1. Acceptance of Terms

By accessing our website or booking our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

HowdyHi provides professional real estate photography, videography, drone aerials, and 3D virtual tour services in the Rio Grande Valley, Texas. Service details, pricing, and availability are subject to change.

3. Bookings and Payment

• Bookings are confirmed upon receipt of payment via our secure online system.
• Prices are quoted in USD. All applicable taxes are the client's responsibility.
• Payment is processed securely by Stripe. We do not store payment card details.
• Prices listed on the site are starting prices. Final pricing depends on property size, location, and selected services.

4. Cancellation and Rescheduling

• 48+ hours notice: Full refund or free reschedule.
• 24–48 hours notice: 50% refund or one free reschedule.
• Less than 24 hours / no-show: No refund. A rescheduling fee may apply.
• Cancellations due to weather or circumstances beyond our control will be rescheduled at no charge.

5. Deliverables and Turnaround

• Photos are delivered within 24 hours of the shoot via a secure download link.
• Video and 3D tours are delivered within 48–72 hours.
• Delivery times are estimates and may vary during peak seasons.
• All deliverables are provided digitally. Physical prints are not included unless specifically arranged.

6. License and Usage Rights

Upon full payment, HowdyHi grants the client a non-exclusive, non-transferable license to use the delivered media for real estate marketing purposes, including MLS listings, social media, and marketing materials related to the specific property photographed.

The client may not:

• Resell or sublicense the media to third parties
• Use the media for any property other than the one photographed
• Remove any embedded metadata or copyright information

HowdyHi retains the copyright to all media produced and may use it in our portfolio, website, and marketing materials.

7. Client Responsibilities

The client is responsible for:

• Ensuring the property is clean, staged, and ready for photography at the scheduled time
• Obtaining permission from property owners and any relevant parties for the shoot
• Providing accurate property access information

If the property is not ready at the scheduled time, we reserve the right to cancel or shorten the session without a full refund.

8. Drone Services

Drone services are subject to FAA regulations, weather conditions, and airspace restrictions. We are FAA Part 107 certified. If a drone shoot cannot be completed due to regulatory or weather restrictions, we will reschedule at no additional charge or provide a refund for the drone portion only.

9. Limitation of Liability

HowdyHi's total liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

10. Dispute Resolution

Any disputes arising from these terms or our services will be governed by the laws of the State of Texas. We encourage resolving disputes informally first by contacting us directly.

11. Changes to Terms

We may update these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the updated terms.
